Chief Justice John Roberts shocked conservatives by siding with the liberal justices in the Supreme Court decision to rule the individual mandate as constitutional. This was shocking because everyone thought John Roberts would be the last person to help the Obama Administration.
John Roberts was made Chief Justice of the Supreme Court after George W. Bush nominated him in 2005 but before the nomination process was completed Chief Justice William H. Rehnquist died on September 3, 2005. Shortly thereafter, on September 5, Bush withdrew Roberts’s nomination as O’Connor’s successor and announced Roberts’s new nomination to the position of Chief Justice. William Rehnquist was appointed by Nixon as a conservative justice, so nominating John Roberts would keep the Chief Justice of the Supreme Court conservative. John Roberts was confirmed and assumed office September 29, 2005, then Senator from Illinois Barack Obama voted against John Roberts because of his conservative views. Fast-forward to 2012, now President Barack Obama is very happy about the decision made by Chief Justice John Roberts to uphold his Healthcare law as the law of the land.
The John Roberts court was taking heat from many liberals as being partisan. The 2010 ruling in the case “Citizens United vs. Federal Election Commission”; allowing unlimited campaign cash contributions without accountability, was the worst ruling since Bush vs. Gore. This and a few other cases was seen as a radical step by the Supreme Court and people started to question the independence of our Judicial branch of the U.S. government. The evidence was growing against the John Roberts Courts as being a conservative strong hold, and the radical republican party was using the court as a way to strike down liberal laws. This was until the final week in June of 2012.
In one week, the Supreme Court redeemed itself from the words of radicalism. To start the week off, the Roberts Court struck down three of the Four Provisions Of The Arizona Bill SB 1070. The only provision kept by the Supreme Court was the racial profiling provision if a police officer thinks a person is in the country illegally then they can ask for papers. The court did leave the door open to overturn this provision if used incorrectly. This was a big victory for the Constitution as the Supreme Court recognized the power of the Executive Branch over states. This was a preview of what was to come in the Healthcare decision, but everyone thought it would be Justice Kennedy to side with the Obama Administration.
On June 28, 2012, the world was shocked to wake-up to a decision made by Chief Justice to uphold the Affordable Care Act. In fact, John Roberts was the only conservative to join the liberal justices in upholding the Healthcare Law. John Roberts upheld the bill because the individual mandate was ruled as a tax, meaning he used the interstate clause as the reason to uphold the bill. Chief Justice John Roberts went out of his way to consider this bill as constitutional by adding this to his written decision. Republican were shocked because he made the argument for the Obama Administration. Instead of going out of his way to strike down the bill, he went out of his way not to overturn a bill passed the people of the House of Reps.
The Justice everyone thought would be the deciding vote Justice Kennedy was against the bill and called for the whole bill to be struck down. Chief Justice John Roberts may have realized his name was on the court, and only he would be remembered as the Justice who overturned a bill passed by Congress and the will of the people.
Chief Justice John Roberts has taken a step to show to the American people that you don’t have to go down party line to get stuff done, but working together will make this country stronger. The Constitution calls for three separate branched of government, Executive, Legislative, and Judicial as check and balances. The Affordable Care Act has gone through the three branched and deemed as good law. Now, let’s move forward and fix other problems hurting this country. Working together as one will only make this country stronger, thanks to Chief Justice John Roberts the American people now know the Judicial Branch is working to make this country better in the future.
