The heart of the lifestyle of being an American and a citizen of the United States is centered around Democracy and freedom. Whether a person agrees or disagrees with the constitution, the beauty of the constitution is that we, as Americans, have the rights to speak our minds and have our own beliefs.
On September 17, 1878 the Constitution of the United States was adopted and officially went into action on March 4, 1789.
In 1791 ten amendments were added to the Constitution. These amendments are officially known as the United States Bill of Rights. The Bill of Rights was written to protect citizens and include the right to a jury trials, right to keep and bear arms, and prohibits “cruel and unusual punishments”.
In modern times, the Second Amendment giving the right to bear arms has come into debate.
Originally this was placed in the Constitution to protect individuals who bear arms for self defense at a time when there was no one else to depend on to protect their homes, families, and belongings. Of course no one is disputing the right to protect oneself and family without fear of retribution. Obviously this was long before all assault weapons and people just randomly shooting into a group of people just for the thrill of killing.
The gun control debate is more about grouping the right to purchase and own all assault type weapons as part of the second amendment.
Whether people believe in the lifestyle of hunters or want a peaceful society with no one allowed to own firearms, no one agrees that there should be a reason to allow folks to be able to legally purchase a firearm made specifically to kill many other human beings. All assault weapons are not used for hunting or target shooting; they are specifically purchased to kill.
James Holmes stockpiled guns, an all assault weapon, and ammo for four to six months before the shooting. How was he able to purchase so many weaponry and ammunition legally with no red flags.
Background checks should be taken seriously in the battle for gun control
Holmes is now known to have been seeing a psychiatrist whom he sent a package to reportedly containing a notebook outlining the attack. Authorities say Holmes purchased a semiautomatic rifle, a shotgun and two pistols legally between May 22 and July 6 at three Colorado gun stores. The background checks required for Holmes to pass in Colorado are so basic that can take as little time as 20 minutes.
There should be a data base safeguard as part of the background check to show the history of what guns and ammo have been purchased by an individual and when they were purchased. Red flags could be raised on people like James Holmes instantly alerting the shop owners as well as authorities who can then retain the would-be purchaser for further questioning, resulting in an inability for that person to attain the weaponry to kill needlessly.
For ten years there was a ban on assault weapons
In 1994 President Clinton signed a ban that made it a crime to own any one of 19 different styles of military type assault weapons. Unfortunately there was a clause placed in that stated that Congress would have to reauthorized the ban after 10 years or let it expire. In 2004 Congress refused to give the reauthorization and the ban on assault weapons expired opening up the floodgates for those who could now purchase these weapons and their high-capacity magazines legally.
Whether you are pro or con about the right to bear arms few will dispute that an individual should have the right to own military type assault weapons. This ban should be reinstated to assist in averting any future tragedies.
The creators of the Constitution did not mean for the second amendment to be a platform for killers.
All sides should now work together to come to a fair and humane solution for gun control defined for this centuries needs. The country is morning the now 13 who died needlessly; it is time to take control of the gun laws.
