The Court’s ruling handed a major victory over to states concerned about their budgets, rights and sovereignty, but it seems to be getting less press than it deserves.
A common theme of the Obama White House has been to intimidate and penalize states, companies and non-union businesses who choose not to comply with their commands. The Department of Justice and Environmental Protection Agency have been using coercion tactics to force compliance to their agendas.
Now the idea that the federal government can use those tactics has been stopped dead in its tracks when it comes to Medicaid funding.
No longer can the Obama Administration force and harass states into submission by threatening penalties of Medicaid funding, according to seven justices. The Court ruled that the federal government can only withhold the funds to expand Medicaid, not existing money that helps states run their pre-expansion programs.
When a state chooses not to accept the federal monies for Medicaid, the federal government cannot coerce that state into Obamacare compliance.
There is a strong possibility that many states will decline to participate in this part of Obamacare and have the freedom to run it as they see fit without incurring a federal penalty.
