In the early hours of the morning yesterday, Chief Justice Roberts, a supposed Conservative, stood before the American public, and, in some peoples’ minds, dealt a death blow to their Constitutional freedom. Although the Supremes rejected the pleas of the Obama administration, that it was the right of the Federal government, under the Commerce clause, to require everyone to buy health insurance, they decided to rewrite the law by changing the penalty provision of the law to a tax. In so doing, they felt free to rule that the individual mandate is Constitutional.
In the opinion, Chief Justice Roberts wrote that the decision offers no endorsement of the law’s wisdom, and that letting it survive reflects “a general reticence to invalidate the acts of the nation’s elected leaders.”
“It is not our job to protect the people from the consequences of their political choices,” he wrote.
The Supreme Court, being the final Constitutional protection that an American citizen has, has the obligation to rule on the Constitutionality based on the facts, without having “a general reticence to invalidate”. That is their job. Chief Justice Roberts and the Liberal gang of four did not do their job and a dangerous precedent has been established. To paraphrase one of the Justices own words, can the government now force me to eat broccoli by threatening to tax (penalize) me?
Although decisions are rarely, if ever, reversed, subsequent cases, as in the 1964 case of Brown v. Board of Education, can change the Court’s thinking and return us to solid Constitutional ground.
Then, why did Roberts do us a favor?
This November may be the most important election in America’s history.
Obamacare, as a Socialist concept, has become a focal point for Conservatives looking to return to the principles of our founding fathers as envisioned in our Declaration of Independence, our Constitution and our Bill of Rights. President Obama is intent on fundamentally changing America, and now we know what this change is. In his world, personal responsibility is no longer operable. Radical socialism is his goal.
An election resulting in the re-election of Barack Obama as President, and/or resulting in Democrat control of the Senate, would prevent any change in Obamacare.
In addition, four more years for Obama could give him the opportunity to stack the Supreme Court with more ultra-liberals, thus rendering the Constitution a thing of the past.
If control of the House of Representatives swings back to the Democrats, say goodbye to individual freedom and hello to total government control of your lives.
Yes, Chief Justice Roberts may have done us a favor. He has awakened Conservatives. He has awakened the Independents and Reagan Democrats, and he has awakened the Tea Party.
Elections do have consequences, and in America, Obamacare and Socialism will not stand.
