Stolen Valor Act deemed unconstitutional…
With the exception of those living in caves or under rocks, just about everyone in this nation knows of the nearly $1 trillion Federal takeover of the nation’s healthcare system.
Popularly known as “ObamaCare,” the controversial law has been deemed Constitutional by SCOTUS (Supreme Court of the United States).
As previously covered by ovalpike.com, the Federal Government can now legally force the American people to use their own money to purchase products or services they may not want in the first place.
Just as long as failure to comply is defined as a tax.
Even if ObamaCare is repealed, it doesn’t make a difference.
The law is still on the books.
One way or another, the American people are going to pay a lot of money out-of-pocket.
Not The Only Controversial Ruling…
The Court also overturned The Stolen Valor Act of 2005, stating that the law interfered with any given individuals “Freedom of Speech,” thusly unconstitutional.
Signed into law in 2006 by then-President George W. Bush, the official website for the SCOTUS states (pgs 6-7) that under the now overturned law, the penalties were as follows:
“(b) FALSE CLAIMS ABOUT RECEIPT OF MILITARY DECORATIONS OR MEDALS.––Whoever falsely represents himself or herself, verbally or in writing, to have been awarded any decoration or medal authorized by Congress for the Armed Forces of the United States. . . shall be fined under this title, imprisoned not more than six months, or both.
(c) ENHANCED PENALTY FOR OFFENSES INVOLVING CONGRESSIONAL MEDAL OF HONOR.–– “(1) IN GENERAL.––If a decoration or medal involved in an offense under subsection (a) or (b) is a Congressional Medal of Honor, in lieu of the punishment provided in that subsection, the offender shall be fined under this title, imprisoned not more than 1 year, or both.”
*IS* His Nose Longer Than a Telephone Wire?
The catalyst for this legal brouhaha was one Xavier Alvarez of California who claimed to be a many times wounded 25-year Marine Corps Force Recon vet, as well as a member of the Army’s Delta Force (photo, left).
Alvarez claimed more than a few combat kills under his belt, to include children.
Failing to serve even one second in the uniform of his country, Alvarez also claimed that he’s the recipient of the highest medal this nation has to offer for “conspicuous acts of gallantry and intrepidity above and beyond the call of duty”: The Congressional Medal of Honor (CMOH).
The whistleblower on Alvarez was former Marine Melissa Campbell, as reported by The Washington Times via the Conservative Commune.
For her act of patriotism, Campbell was fired from her civilian job.
What Real CMOH Recipients Say and Do…
As reported by The Times, legitimate heroes are none-too-thrilled with the recent overturning by the SCOTUS:
“Maj. Gen. Patrick H. Brady (USA ret.), a genuine Medal of Honor recipient (Vietnam), told me: ‘I just can’t understand how anyone, including judges, can believe that General George Washington and the Founding Fathers intended to create a First Amendment Constitutional ‘right to lie’ about military service and receiving the Medal of Honor or other medals of valor.
It just defies common sense.”
Another example of what a true Medal of Honor recipient must do is the case of Sergeant Major Dan Daly, USMC.
As a young Private defending the Foreign Legations in Peking, China during the 1900 Boxer Rebellion, Private Daly was assigned to a gateless opening in the protective wall and ordered “let no one pass.”
Alone but with plenty of ammunition, Daly held the gate secure until eventually relieved.
The following day, the gate opening was clogged by over 200 Chinese “Boxers” who were killed at Daly’s hand.
Who Voted How, and the Possible Fallout…
Voting to overturn The Stolen Valor Act were Chief Justice Roberts, Associate Justices Bryer, Ginsburg, Kagan, Kennedy, and Sotomayor.
Dissenting were Associate Justices Alito, Scalia and Thomas.
It’s Legal Now…
In 1989 and 1990, SCOTUS overturned laws protecting the American flag from various forms of desecration, all in the name of Freedom of Speech.
The overturning of The Stolen Valor Act as well as various laws protecting the dignity of the same flag that tens of millions have served under, and roughly one million died for, now opens the real possibility that any given individual who never served a moment of his life in the service of his country can now wear Marine Dress Blues complete with the CMOH.
The same attired individual can now desecrate our flag in any manner he so desires.
Fecal matter rubbed on it, urine poured in it, vomited upon, burned… it’s all perfectly legal, and ironically enough, supposedly what The Founding Fathers would have wanted.
